VG Paterakis – Terms & Conditions of the Shop

1. Introduction
1.1. Our company, under the name “VG Paterakis,” with its registered seat in Kissamos, Crete, at Skalidis 94, with Tax Identification Number EL099696141, Chania Tax Office, (hereinafter the “Shop”), operates a retail store selling fresh fish and meat products. These Terms and Conditions (“Terms”) govern purchases made in-store, online (if applicable), or via phone.
1.2. By shopping at VG Paterakis, you agree to these Terms, which should be read alongside our Privacy Policy (available upon request). If you disagree with any part of these Terms, please refrain from making purchases. Using our services implies unconditional acceptance of these Terms.
1.3. Sales are made to natural persons with legal capacity (over 18 years of age) and to legal persons for personal consumption only, not for resale or commercial exploitation. The Shop reserves the right to refuse service if these conditions are violated.

2. Purchases
2.1. In-Store Purchases: You can visit our shop in Kissamos to select fresh fish and meat products. No account is required for in-store purchases.
2.2. Online/Phone Orders (if applicable): If we offer online or phone ordering, you may create an account to track orders, save preferences, or monitor product availability. Account creation requires accurate, up-to-date information, and you warrant that the data provided is true.
2.3. Account Deletion: You may delete your account (if applicable) by contacting us. Upon deletion, your data will be removed from our system, except for records required for legal purposes, which may be anonymized.
2.4. The Shop reserves the right to delete accounts or refuse orders for reasons such as breach of these Terms or illegal conduct.

3. Order Placement
3.1. In-Store: Select products and complete your purchase at the counter.
3.2. Online/Phone Orders (if applicable): Add products to your cart, provide shipping details, and accept these Terms before submitting. Orders are proposals to purchase, subject to availability confirmation.
3.3. Order Confirmation: For online/phone orders, you will receive an email or call confirming receipt of your order. We reserve the right to verify product availability and pricing. If items are unavailable or incorrectly priced, we will contact you to:

  • Execute the order for available items, refunding unavailable items and adjusting shipping costs (if applicable).
  • Cancel the order entirely, refunding the full amount.
    3.4. Order Completion: A final confirmation will be sent when the order is ready for pickup or delivery, confirming the sale contract.
    3.5. Phone Orders: Governed by these Terms, phone orders require a valid email or contact number for updates. Calls may be recorded for transaction security.
    3.6. Cancellation: We may cancel orders due to unavailability or other issues, notifying you promptly with a full refund if payment was made.

4. Prices
4.1. Prices are in Euros (€) and include VAT. They apply to in-store, online, or phone purchases and may differ from other retailers. Shipping costs (if applicable) are additional and will be communicated before order completion.
4.2. We strive to display accurate prices. If an error occurs (e.g., a significant price discrepancy), please inform us and refrain from ordering. We reserve the right to correct pricing errors and cancel orders if necessary.
4.3. The Shop may modify prices, offer discounts, or run promotions at its discretion, with updates posted in-store or online.

5. Delivery and Pickup
5.1. In-Store Pickup: Products are available for pickup during operating hours.
5.2. Delivery (if applicable): Deliveries are made within Crete via third-party courier services. Delivery times depend on the courier, order time, and your address. You can track orders using the courier’s tracking number.
5.3. Shipping Costs: You bear delivery costs, which are displayed before order completion. Free delivery may apply for orders above a certain amount (e.g., €50), as indicated at checkout. Additional fees (e.g., cash-on-delivery) will be communicated.
5.4. The Shop is not liable for delivery delays due to force majeure, incorrect address information, or your absence during delivery. If delivery fails, the courier will contact you to arrange pickup, or the order may be canceled with a refund.
5.5. Perishable goods must be refrigerated promptly upon receipt. The Shop is not responsible for spoilage due to delayed receipt or improper storage.

6. Payment
6.1. Payment Methods:

  • In-Store: Cash, credit/debit card, or POS.
  • Online/Phone (if applicable): Credit/debit card, PayPal, or cash-on-delivery (subject to legal cash limits). Payments are processed securely via trusted banking institutions.
    6.2. We do not store payment details; these are handled by third-party payment providers. You are responsible for providing accurate payment information.
    6.3. The Shop may modify payment methods, with updates posted in-store or online.

7. Returns and Refunds
7.1. Perishable Goods: Due to the nature of fresh fish and meat, returns are not accepted unless products are defective or incorrect. You must notify us within 24 hours of receipt at +30 28220 22220 or shop@vgpaterakis.gr.
7.2. Defective/Incorrect Products: If products are defective or not as ordered, you may return them within 24 hours, subject to inspection. Returns must:

  • Be in original condition and packaging.
  • Include all accompanying documents (e.g., receipt).
  • Be refrigerated properly to prevent spoilage.
    7.3. Return Process: Contact us to arrange return via courier (if applicable) or in-store. You bear return shipping costs unless the error is ours. Refunds will be issued to the original payment method within 7 days of receiving the returned goods.
    7.4. Non-Returnable Items: Products cannot be returned if spoiled due to improper handling or storage by the customer.
    7.5. Withdrawal: For non-perishable items (if any), you may withdraw within 14 days of delivery, provided the product is unused and in original packaging. Contact us to initiate withdrawal. Refunds exclude shipping costs and are processed as per section 7.3.

8. Liability
8.1. We strive to provide high-quality, defect-free products. If you receive defective goods, contact us immediately to exercise your legal rights (e.g., replacement or refund). You bear the burden of proving defects after 24 hours from delivery for perishable goods.
8.2. The Shop is not liable for damages, including spoilage, due to customer mishandling, incorrect delivery information, or force majeure. We do not guarantee uninterrupted service for online/phone orders or error-free pricing.
8.3. Product descriptions (e.g., weight, origin) are provided by suppliers. We are not responsible for inaccuracies in supplier-provided information.
8.4. Our liability is limited to the product’s purchase price for any proven fault on our part.

9. Intellectual Property
9.1. All content, logos, and trademarks in the Shop, website (if applicable), or promotional materials are protected by Greek law. You may not reproduce, modify, or use them without our written consent.
9.2. Use of our website or services does not grant any license to exploit our intellectual property.

10. Amendments
10.1. We may update these Terms at any time, with changes posted in-store or online. Check this page before placing orders.
10.2. We may modify product offerings, prices, or promotions without notice.
10.3. Invalid or unenforceable terms do not affect the validity of remaining terms.

11. Applicable Law and Jurisdiction
11.1. These Terms are governed by Greek law. Disputes are subject to the exclusive jurisdiction of the Courts of Chania, Crete.
